”That he was born in the county of Isle of Wight in State of Virginia about the year 1753, but he is not certain about the precise date nor is the day or month now recollected or the record of his age”…” he was about 22 years of age he removed from Virginia and settled in what was then the county of Bute and state of North Carolina near the same place where he has remained ever since the Revolutionary War and where he now resides and in that portion of the county of Bute which now forms Franklin County”...

Daniel Wester signed an Oath of Allegiance in Bute Co. NC

There were 6 sons born to Daniel Wester...Benjamin, James, Hudson, Lockey, Axum, and John.

When Daniel’s son Axum died he had never married or had children and his brothers fought through the court system for rights to his property. In the court papers over the division of the property in 1850’s it names all his brothers (except Locky who had already died)  and all their children! Although the court threw the claims of these brothers out – the documents survive in the NC Archives.

In the name of God Amen, I Edmond Westray of Isle of Wight County of sound mind and memory 
thanks be to Almighty God for it, I do make this my last will and testament in manner and form 
following:

Item, I give to my son Jeremiah Westray ten pounds case, and one small gun to him and his heirs  forever. Item, I give to my daughter Sophia Vick ten pounds cash to her and her heirs forever. 
Item, I give to my three sons Joseph, Samuel and Elias Westray twenty shillings cash a piece to 
them and their heirs forever. Item, I give to son Levy Westray the plantation I now live on 
with one hundred acres of land and all the rest of my estate within doors and without to him 
and his heirs forever after my debts paid. I do leave my sons Jeremiah and Levi Westray my 
whole and sole executors, revoking all other wills heretofore made by me as Witness my hand and 
seal this 13th day of July 1795.

At a court held for Isle of Wight County the 7th day of December 1795, this will was presented 
in Court by Levi Westray, one of the executors therein named, who made affirmation thereto 
according to law and the same being proved by the oaths of Nelson Westray, Jacob Parkerson, and
John Parnall the Witnesses thereto and ordered to be recorded, and on the motion of the said 
executor, who together with Joseph Westray, his security entered into, and acknowledged their 
bond in the penalty of three thousand pounds with consideration as the law directs, certificate
is granted him for obtaining a probate thereof in due form and liberty served the other 
executors therein named to qualify as such when he shall think proper.

In the name of God Amen, I Benjamin Westray of the Isle of Wight County, being sick and weak in 
Body but of a sound memory, Thanks be to the Almighty God for the same, and calling to 
Remembrance the uncertain state of this transitory life do make, ordain and constitute to be 
my last Will and testament in manner and form following;

Item, I give and bequeath unto my well beloved wife Lucy Westray, during her life or 
widowhood, Ten head of cattle, one black horse, Ten head of Sheep, Twenty five head of hogs, 
three feather Beds and furniture, The whole of the pewter, all the pots and pans with all the 
house hold furniture and one Negro fellow called David, and after her life or widowhood the 
whole of the said estate; I give and bequeath unto my children Matthew, Chloe, Mills, Sally and
John, to be equally and fairly divided, between and amongst them. Item, I give and bequeath 
unto my son Matthew Westray One tract of land containing seventy five acres, being the tract of 
land formerly belonging to Benjamin Tomlin, Dec, one forty gallon still, and one young bay mare 
to him and his heirs forever. Item, I give and bequeath unto my daughter Chloe Westray one 
Negro fellow called Dick to her and her heirs forever. Item, I give and bequeath unto my 
daughter Sally Westray three hundred pounds lawful money to her and her heirs forever. Item, I 
give and bequeath unto my son Mills Westray a certain tract or parcel of land whereon William 
Westray now lives containing fifty acres, and one gun to him and his heirs forever. Item, I 
give and bequeath to my son John Westray my manor plantation containing fifty acres to him and 
his heirs forever. Item, I give and bequeath unto Margaret Tomlin, the widow of Benjamin 
Tomlin, deceased, two cows. Item, I desire that the residue of my estate of all kind may be 
sold and after paying my debts and making good the legacy to my daughter Sally Westray, the 
balance if any I give and bequeath to all my children to be equally and fairly divided amongst 
them and I do hereby appoint my friend and brother William Westray executor of this my last 
Will and testament in Witness whereof I do here unto set my hand and affix my seal this tenth 
day of January, one thousand seven hundred and eighty.
